1. The Get In The Brending Ripple account owner (YOU), (herein referred to as 'Owner') agrees to waive liability of Rippln. (the parent company) (herein referred to as 'Get In The Brending Ripple') from any claims resulting from misuse of the software. Owner agrees to defend, indemnify and hold harmless Get In The Brending Ripple and its affiliated companies, from all liabilities, claims and expenses, including attorneys' fees, arising from breach of this Agreement. Get In The Brending Ripple software may only be used for lawful purposes.

2. By purchasing this product you, the Owner, and any and all third-parties or assignees of said Owner, agree to use Get In The Brending Ripple software, in accordance with the policies stated in this legal notice and in compliance with any and all applicable local, state, and federal laws of the United States of America.

3.Get In The Brending Ripple completely disclaims any and all responsibility for any Owner found to be using Get In The Brending Ripple's software for unlawful purposes whether in violation of local, state and federal laws of the United States of America.

4.Owner understands that use of the Get In The Brending Ripple software is only granted to those individuals, companies and organizations that make appropriate payment to Get In The Brending Ripple. Owner further agrees that Get In The Brending Ripple has the right to deactivate the software if payment later fails, if Owner requests a refund or chargeback, or if Owner engages in unlawful activity with the Get In The Brending Ripple software.

5.Owner must adhere to the CAN-SPAM (Bill S. 877 – took effect on January 1, 2004). Owners determined to be in violation of this law will be terminated from the Get In The Brending Ripple system.

6.Owner agrees that the Get In The Brending Ripple system URL issued to you (http://brending.getintheripple.com) can NOT be used in mass emails unless you own the list. Ownership of a list means you developed the list on your own website. Under NO circumstances are you to use your URL in an email sent to a purchased list. Purchased lists include, but are limited to, list acquired from list brokers, lists emailed for you by a company providing that service and lists given to you by someone.

7.Owner agrees that Get In The Brending Ripple has the right and responsibility to terminate an account who is in violation of the mass email policy. Furthermore, termination will also occur if we receive spam complaints against your account. We have a ZERO tolerance policy regarding spam complaints.

8.Owner understands that the Get In The Brending Ripple system URL (http://brending.getintheripple.com) can not be submitted to search engines, forums or auction sites like eBay or craigslist. Owner understands that all traffic sources are being tracked and those not allowed will be blocked.

9. Get In The Brending Ripple makes no warranties of any kind for the software it provides, whether expressed or implied. Get In The Brending Ripple will not be held liable for any damages suffered to owner.

10. Get In The Brending Ripple DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR FREE OR UNINTERRUPTED. THE SOFTWARE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PURPOSE. Get In The Brending Ripple WILL NOT BE RESPONSIBLE FOR ANY LOSSES, DAMAGES OR COSTS THAT YOU AND/OR YOUR BUSINESS MAY SUFFER WHEN USING THE SOFTWARE. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS Get In The Brending Ripple FROM ANY CLAIMS RESULTING FROM YOUR USE OF Get In The Brending Ripple SOFTWARE. YOU EXPRESSLY AGREE THAT USE OF Get In The Brending Ripple SOFTWARE IS AT YOUR SOLE RISK. NEITHER Get In The Brending Ripple NOR ITS SERVICE PROVIDERS, AGENTS, LICENSORS, EMPLOYEES SHALL HAVE ANY LIABILITY FOR ANY DAMAGES SUFFERED BY YOU OR ANY OTHER PARTY AS A RESULT OF THE USE OR MISUSE OF THE Get In The Brending Ripple SOFTWARE.

11. Should any paragraph of this agreement be considered illegal, invalid, or unenforceable by a court of law, the legality, validity and enforceability of the remaining paragraphs of this agreement shall remain unaffected thereby unless otherwise stated.

12. This service agreement is governed by the laws of the state of Ohio and of the United States of America.

13. These Terms and Conditions supersede all previous written, verbal or implied provisions. Use of Get In The Brending Ripple software constitutes acceptance of these Terms and Conditions. Get In The Brending Ripple reserves the right to make changes and amendments to these terms and conditions at any time. Get In The Brending Ripple agrees to notify account owners of any changes or amendments by email OR by posting changes on this page.

Cancellation and Refund Policy

The Get In The Brending Ripple account owner (YOU), (herein referred to as 'Owner') agrees to waive liabilty of (the parent company) (herein referred to as 'Get In The Ripple') from any claims resulting from misuse of the software. Owner agrees to defend, indemnify and hold harmless Get In The Brending Ripple and its affiliated companies, from all liabilities, claims and expenses, including attorneys' fees, arising from breach of this Agreement. Get In The Brending Ripple software may only be used for lawful purposes.

By purchasing this product you, the Owner, and any and all third-parties or assignees of said Owner, agree to use Get In The Brending Ripple software, in accordance with the policies stated in this legal notice and in compliance with any and all applicable local, state, and federal laws of the United States of America.

Member agrees to the following payment arrangement for access to the Membership. A new Member is charged $9.95 for setup and the first months hosting and then $9.95 each 30 days thereafter, or one annual payment of $99.95, until such time as the member cancels the membership.

If the member cancels, members access to the members only area and Get In The Brending Ripple website will cease at the end of the monthly billing cycle as appropriate.

Member understands and agrees that they will be charged a monthly membership fee of $9.95 and that completion of the order on this page is a monthly recurring membership and not a one time charge. If member selected one annual payment of $99.95 there will be no monthly billing.

The Member may cancel their Membership at any time, without cause at least three days prior to the next billing cycle, and incur no further charges.

Member agrees that it is the members responsibility to initiate any and all cancellations by submitting a cancellation request in the members logged in area by submitting a Support Ticket.

Member understands and agrees that no cancellation requests will be accepted via phone, fax, or email, and that the only method of cancellation is by submitting a cancellation request in the members logged in area by submitting a Support Ticket.

Member agrees that there are no refunds given under any circumstances past the 30 day guarantee.

In addition, Member agrees that there are no partial refunds for monthly fees incurred, and that it is the Members responsibility to cancel their Membership.

Member agrees that failure to cancel their membership prior to the scheduled re-billing date will not be accepted as a reason for a refund of the current payment and that there are no full or partial/pro-rated refunds for any reason past the 30 day guarantee.

Member also agrees that upon cancellation, all access to the Membership will cease immediately, all system URL's will stop working and Get In The Brending Ripple is not responsible for any lost data that may occur due to cancellation.
